Terms of Service

1. Acceptance of Terms

By accessing or using HostCoord, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Platform. These Terms constitute a legally binding agreement between you and HostCoord.

2. Description of Services

HostCoord provides a specialized platform designed for verified hosts of furnished apartments and bed & breakfasts. Our services include property management tools, calendar synchronization, host-to-host communication channels, and booking coordination features.

We act as a facilitator for host collaboration and management but are not a party to any rental agreements between hosts and guests unless explicitly stated otherwise.

3. Eligibility and Registration

• Eligibility: You must be at least 18 years old and legally capable of entering into binding contracts to use our Platform. You must also be a verifiable host or property manager.
• Account Registration: To access certain features, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
• Verification: HostCoord reserves the right to request proof of property ownership or management authority (e.g., business permits, title deeds, or lease agreements) to verify your host status.
• Security: You are responsible for safeguarding your password and agree not to disclose your password to any third party. You are responsible for any activity using your account, whether or not you authorized that activity.

4. Acceptable Use Policy

You agree not to use the Platform for any unlawful purpose or in any way that interrupts, damages, impairs, or renders the Platform less efficient. Specifically, you agree not to:

• Post false, inaccurate, misleading, defamatory, or libelous content.
• Violate any applicable local, state, national, or international law, including housing and zoning laws.
• Infringe upon the intellectual property rights of HostCoord or others.
• Distribute viruses or any other technologies that may harm the Platform or the interests or property of users.
• Harvest or otherwise collect information about users, including email addresses, without their consent.
• Attempt to bypass any measures we may use to prevent or restrict access to the Platform.

5. Subscription and Payments

Some features of HostCoord are available only with a paid subscription. By selecting a paid service, you agree to pay the applicable fees and taxes.

• Billing: Subscription fees are billed in advance on a recurring basis (monthly or annually).
• Changes: We reserve the right to change our subscription fees at any time, but will provide you with reasonable prior notice.
• Cancellation: You may cancel your subscription at any time. Your cancellation will take effect at the end of the current paid term. There are generally no refunds for partial months or unused services.

6. Intellectual Property Rights

The Platform and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by HostCoord, its licensors, or other providers of such material and are protected by copyright, trademark, and other intellectual property laws.

7. Termination

We may terminate or suspend your account and bar access to the Platform immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

8. Limitation of Liability

In no event shall HostCoord, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory.

9. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Platform shall be resolved through amicable negotiations. If negotiations fail, the dispute shall be submitted to arbitration in accordance with the Arbitration Act of Kenya.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
